Personal Injury

Under Civil Code section 3333, a person may recover damages from bodily caused by another in an amount to compensate for all the detriment proximately caused thereby. These "damages" include special and general damages. Special damages generally include economic damages, i.e., medical and related expenses, loss of income, and the loss or cost of services. General damages refers to non-economic damages, i.e., pain, suffering, emotional distress, and other non-quantifiable harm.

Most personal injuries are plead under general theories of negligence. However, depending upon the circumstances, the law may afford recovery for intentional conduct (assault / battery) or even under strict liability standards where liability is not even considered (pet attacks).
